Election Committee The Election Committee is elected by the Delegate Assembly.  Under article viii, section 3a of the PSC Constitution the Election Committee shall:

draft rules and requirements for elections and the filling of vacancies to be considered for adoption by the Delegate Assembly, conduct elections of the Professional Staff Congress, review and make recommendations to the Delegate Assembly regarding disputed elections, and conduct referenda authorized under Article XIII, Section 5.

NOTICE OF NOMINATIONS AND ELECTION -- DELEGATES TO AAUP ANNUAL MEETING -- JUNE 2008

Election Schedule

  1. Nomination Petitions shall be available on March 31, 2008.
  2. Nomination Petitions shall be returned to the PSC no later than April 21, 2008.
  3. Ballots will be mailed to the home addresses of all eligible voters on May 12, 2008.
  4. Ballots must be received at the PSC Office (uncontested election) or the American Arbitration Association (contested election) no later than 5 PM on June 2, 2008.
  5. Ballots will be counted on June 3, 2008.

To Be Elected: 15 Delegates to 2008 AAUP Annual Meeting. 

Eligibility for Holding Office: PSC members who have been members in good standing of the PSC for at least 4 months prior to the mailing of the ballots (since 1/12/08) and are included among those who have been identified by the PSC Executive Council as members of the PSC Chapter of the AAUP shall be entitled to hold position as delegate to the AAUP 2008 Annual Meeting. 

Voting Eligibility: PSC members who have been members in good standing of the PSC for at least 4 months prior to the mailing of the ballots (since 1/12/08) and are included among those who been identified by the PSC Executive Council as members of the PSC Chapter of the AAUP shall be entitled to vote in the election of delegates to the AAUP 2007 Annual Meeting. 

Nominating Procedure: Nomination of an individual or a slate must be by official nominating petition signed by no fewer than twenty-five (25) of the identified members in good standing of the PSC Chapter of the AAUP.  (List is available at the PSC Office.)  For all candidates, petitions shall include: (a) the printed name, signature, department and college of each petitioner and (b) the printed name, signature, department and college of the nominee, as well as the office being sought by the nominee.  A candidate’s signature on a slate petition shall constitute that candidate’s acceptance of the slate designation. 

Slate Regulations:  A slate of candidates will be recognized if it consists of candidates for twenty-five percent (25%) or more of the delegates to be elected (four (4) or more) and if it submits prior to the close of nominations:  (a) a listing of slate's delegate candidates, including the person designated to authorize nominees for the slate; and (b) the names of the members of the caucus's Committee on Vacancies which, unless otherwise designated shall be the caucus nominating committee, authorized to replace any candidate on the slate whose name is withdrawn no later then seven (7) days prior to the mailing of the ballots. 

Balloting: All voting must be on the official PSC ballot.  Write-in votes are permitted.  A write-in vote shall be valid if the intent of the voter is clear: written, printed and typed names are acceptable.  A write-in candidate must meet the same eligibility requirements as a regular candidate.  Write-in candidates who are elected must submit written acceptance of office to the Elections Committee within ten calendar days of notification that their election has been certified. 

Campaigning: Declared candidates may mail literature at their own expense, either directly or through the PSC mailing house.  At the request of the candidate and at cost, the PSC will provide the mailing house with a home-addressed download of the eligible membership.  Candidates must notify the PSC five business days in advance of the mailing to allow sufficient time for the ordering of labels.  (See Barbara Gabriel in the PSC Office to file the required forms.) 

Election Tally: Each candidate, or a representative of the candidate, is entitled to be present at the counting of the ballots.   

Challenges: Challenges to the election results, if any, must be filed with the Elections Committee on or before 5 PM on June 3, 2008 and will be considered by the Elections Committee on June 6, 2008. 
 

2008 PSC-CUNY CHAPTER ELECTIONS*

Half of the PSC chapters were up for election in April, 2008.  Ballots were counted on April 29th.  Results will be published once the elections are certified. PSC Election Rules specify that:,

The Elections Committee will meet no sooner than five (5) nor later than ten (10) working days after the count either to certify the election results or to recommend action on challenges.  Any challenge to an election must be made in writing to the Elections Committee within five (5) working days of the counting of the ballots.  Should the claimant wish to challenge the decision of the Committee, he or she shall appeal to the Delegate Assembly, which shall render a final decision.

The following is a list of all Chapters that held elections in the spring 2008:

Manhattan EOC Chapter Election

►Nominating petitions will be available on Monday, August 27, 2007.
►Nominating petitions must be returned at the PSC office by 5 PM on Monday, September 24, 2007.
►Ballots will be mailed to members on Thursday, October 4, 2007
►Ballots must be returned by 5 PM on Monday, November 5, 2007.
►Ballots will be counted at 10 AM on Tuesday, November 6, 2007.

INCUMBENTS BIG WINNERS IN ELECTIONS

On Friday, May 4, the PSC Elections Committee certified 2007 election results for all of the chapters listed on the chart below (with the exception of Manhattan EOC and Registrars, from which the PSC received no candidate petitions).

The American Arbitration Association (AAA) counted the ballots in the three contested elections -- BMCC, HEOs and KBCC.  Incumbents won handily in each of those elections.  Click below to see the certified results.

The PSC counted ballots in-house for all of the elections for which there were no contested positions as of March 7, 2007, the deadline for candidates to submit petitions.  However, in one case, Brooklyn EOC, a write-in campaign prevailed.  The Brooklyn EOC results, plus a listing of ballots mailed and ballots received (votes) for all elections can be viewed by clicking here.

In each of the Chapters listed below (except Manhattan EOC and Registrars), voters elected the Chapter Chairperson, Vice Chairperson, Secretary, up to four Officers-at-Large, Delegates to the Delegate Assembly (in addition to the

The dates for Spring 2007 elections were:

  • February 5, 2007 – Nominating petitions will be available
  • March 5, 2007 – Nominating petitions must be received
  • April 2, 2007 – Ballots will be mailed
  • April 26, 2007 – Ballots must be received
  • April 27, 2007 – Ballots will be counted

Eligibility to vote.  Article III, Section 5a of the PSC constitution stipulates:

No person shall be permitted to vote in any general election or referendum who has not been a member in good standing for at least four (4) months prior to the date for the mailing of ballots.

To vote in the Spring 2007 chapter elections, one must be a member in good standing by Friday, December 1, 2006.

Certification of Elections:  As stipulated by Section V, part I of the election rules:

2006 PSC-CUNY ELECTIONS

Incumbent New Caucus Slate Wins

On April 25, 2006, the American Arbitration Association counted ballots in the unionwide election to choose the PSC’s principal officers and the rest of its Executive Council. The incumbent New Caucus slate won every contest, defeating the CUNY Alliance with an average of 54% of the vote. PSC President Barbara Bowen was re-elected with 3,201 out of 5,856 votes. Election Committee Rules Against
CUNY Alliance Challenge

On May 2, 2006, the CUNY Alliance filed a challenge to the PSC Election Committee.  The Election Committee heard the challenge and issued a seven-page decision/report, dated 5/15/05,  denying the challenge and certifying the election.  Click here to read the decision.  The CUNY Alliance then appealed to the PSC Delegate Assembly, stating new grounds for its protest.  Click here to read the Election Committee response to these new grounds. The PSC Delegate Assembly, when it met on Thursday, May 25th, affirmed the Election Committee's decision/report and certification of the election results.

AFT Dismisses CUNY Alliance Challenge

Subsequently, the CUNY Alliance filed a challenge with the American Federation of Teachers (AFT), the parent federation of the PSC.  Article VI, Section 14(b) of the AFT constitution gives the AFT Executive Council authority to investigate where a local election "appears to have been conducted in violation of the local or state federation constitution, the AFT Constitution or applicable federal law."  The AFT reviewed the CUNY Alliance's charges and the PSC's response.  In a letter dated August 28, 2006 and signed by Secretary-Treasurer Nat LaCour, the AFT determined that "there is insufficient basis to conduct a full investigation under the AFT Constitution" and that "the challenges filed by the Alliance should be dismissed."  (Click here to read the full text of the AFT letter from Nat LaCour responding to the CUNY Alliance election challenge.)

U.S. Dept. of Labor Rejects Complaint

In June 2007, the federal Department of Labor dismissed an appeal by PSC members affiliated with the CUNY Alliance, a caucus within the union, alleging violations in the way the 2006 elections for the PSC leadership were conducted. After availing itself of the established appeals process, taking the its challenge to the PSC  Elections Committee, the PSC Delegate Assembly and the AFT. the CUNY Alliance asked the U.S. Department of Labor for a ruling. At each level that the complaint was rejected, the DOL conducted an exhaustive investigation before deciding to take no action on the complaint. Democratic union structures are a source of strength, and the PSC is pleased that its elections are open to scrutiny and a process for challenges, and also pleased that the 2006 election has been found to be fair several times over.
